Terms of Service
These Terms of Service govern your access to the ByteForge website and the software development, product engineering, and related services we provide. By using this site or engaging ByteForge, you agree to these terms.

Acceptance of terms
By accessing this website or engaging ByteForge for services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the site or our services. If you accept on behalf of a company, you confirm you are authorised to bind that company.
Services we provide
ByteForge provides software development, product engineering, SaaS platform work, dedicated development teams, staff augmentation, legacy modernisation, and related consulting, as well as our own software products such as MergeForge. The scope, deliverables, timeline, and fees for any engagement are defined in a separate written agreement or statement of work (SOW), which prevails over these terms where they conflict.
Engagements and scope
Client work is delivered under an individually agreed SOW or contract that sets out scope, milestones, acceptance, and responsibilities. Changes to scope are handled through a written change process. Nothing on this website is a binding offer or quote.
Fees and payment
Fees, currencies, and payment schedules are set out in the applicable SOW or invoice. Unless agreed otherwise, invoices are payable within [X days] of the invoice date, and we may suspend work on overdue accounts. Fees exclude applicable taxes unless stated.
Intellectual property
On full payment, ownership of the final deliverables created specifically for you under an engagement transfers to you as set out in the governing agreement. ByteForge retains ownership of its pre-existing materials, tools, know-how, and reusable components, and may reference the engagement in its portfolio unless a confidentiality agreement provides otherwise. Website content, branding, and MergeForge remain the property of ByteForge.
Confidentiality
Each party protects the other's confidential information and uses it only to perform the engagement, subject to any separate non-disclosure agreement. We can discuss and sign an NDA before you share sensitive project detail.
Warranties and disclaimers
We perform services with reasonable skill and care. Except as expressly stated in a signed agreement, the website and services are provided as is, without further warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, ByteForge is not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, data, or business, arising from the website or services. Where liability cannot be excluded, our total liability for an engagement is limited to the fees paid for that engagement, unless a signed agreement states otherwise.
Term and termination
Either party may terminate an engagement as set out in the governing agreement, for example on written notice or for uncured material breach. On termination you pay for work performed and accepted up to the termination date. Terms that by their nature should survive — including intellectual property, confidentiality, and limitation of liability — continue to apply.
Governing law
These terms are governed by the laws of [governing-law country/state], without regard to conflict-of-law rules, and the courts of [jurisdiction] have exclusive jurisdiction, unless a signed agreement specifies a different governing law or venue.
Dispute resolution
If a dispute arises, contact us first so we can try to resolve it directly and in good faith. If we cannot resolve it informally, the dispute is subject to the governing law and jurisdiction above or any dispute-resolution mechanism agreed in the governing contract.
Changes to these terms
We may update these terms from time to time. The version published on this page with the date above applies to your current use of the site. Continued use after an update means you accept the revised terms.
